Gym/Recreational Activity Injuries

Health clubs and recreational activities have become a major part of our lives. Some of these activities involve a higher risk of injury. These activities range from working out in a health club to playing outdoor sports such as football and baseball.

California law allows for owners of health clubs and organizers of recreational events to claim that under certain circumstances, and injured participants should not be able to bring a legal action for the harm that they suffered because the participants “assumed certain risks inherent in the recreational activity”. Moreover, heath clubs and organizers of recreational activities require members and participants to sign “waivers” where they are required to relinquish their legal right to compensation in the event of an injury, prior to being allowed to work out or participate in an event. These waivers have been held to be valid by California courts.

Fortunately, there are certain exceptions to the “assumption of risk” rules, and these exceptions allow seriously injured persons to overcome these “waivers” and bring a lawsuit for damages.

The legal action to overcome recreational activity waivers is a very complicated one, and it requires specialized legal experience. In 2012, Tal Rubin fought passionately on behalf of a seriously injured member of a 24 Hour Fitness health club, who was injured when his trainer negligently dropped a barbell on the member’s face during a workout. Mr. Rubin fought hard on behalf of his client for two years, overcoming many motions and other legal obstacles, before proceeding to a long jury trial. At the end of a hard fought legal battle, the jury returned a verdict in excess of $895,000 against the health club and in favor of the injured member.
